In its Global Litigation Survey of the systems in 137 jurisdictions, the law firm concludes that ‘commercial parties are increasingly seeking out new opportunities in emerging markets, often with relatively undeveloped legal and judicial systems’. As a result of using untried systems, there is a ‘shift in emphasis’ to ensure that legal due diligence is ‘thorough and accurate’. Allen & Overy says: ‘A full understanding of legal risk, as well as economic and political risk, is likely to be central to a business's investment decisions in relatively untested jurisdictions.’ Source: A&O
