Baker Botts has avoided paying damages on a $40.5 million verdict after it was ruled that the plaintiff took too long to file the case. A Texan jury found the firm liable over losses incurred by its former client Axcess international which claimed Baker Botts had a conflict of interest when it represented Axcess’s main competition in securing similar patent protections.
The court found that Axcess had known of the conflict of interest for too long before it issued proceedings.
