BP considers next appeal stage over Deepwater Horizon

BP has received another setback in its aims to limit compensation payments relating to the 2010 Gulf of Mexico oil spill at Deepwater Horizon.

Federal Judge Carl Barbier has rejected the oil giant's claims that the definition of what is an acceptable claim should be narrowed. Not only did Judge Barbier, in the hearing in the New Orleans District Court, reject BP's claim but it criticised the tactics of BP over the way it is handling its arguments. In particular, the Judge criticised the chief executive Bob Dudley for launching 'unfair, inappropriate, personal attacks' over the claims, according to the Financial Times. BP's hopes of restricting the claims now lie in taking another appeal.

Fifth Circuit

It seems likely that, unless it can win in court, BP will be paying out more than double the US $7.8 billion which it first expected to pay to organisations and individuals who claim they lost out because of the oil damage. BP now looks likely to take its appeal to the Fifth Circuit appeals court. After Judge Barbier's ruling, BP said that it would review 'all available legal options'.
