Mr Justice Popplewell in the High Court ordered the disclosure of documents relating to Mukhtar Ablyazov who is in dispute with JSC BTA Bank . He used to be chair of the Kazakhi bank. The bank has alleged that Mr Ablyazov embezzled funds. It is now trying to recover its assets in a dispute worth US$4.6b.
Abuse of relationship
Saying that Mr Ablyazov’s relationships with the firms were ‘an abuse of the ordinary relationship of client and solicitor’, the judge said: ‘The solicitors were being deceived to a very substantial extent about aspects of Mr Ablyazov’s holdings in, and dealings with, assets, whilst being retained to conduct the litigation under the pretence that what they said on their client’s behalf in relation to the assets was complete and true.’ Source: Law360
