Court rules against secret recording of phone calls by lawyers

Lawyers do not get protection under the law for secretly recording phone calls when gathering evidence in lawsuits, according to the Washington Appeals Court.

At issue was a recording made by lawyers in Seattle-based Davis Wright Tremaine. But the acceptability of the recording was challenged on the grounds that it violated privacy laws. Washington has strong privacy laws which require the consent of all parties when conversations are recorded. Davis Wright sought to argue that there were special circumstances if a recording took place in the course of gathering evidence for a law case. But the court would not accept this stance, saying that the recording was not 'protected activity simply because it is undertaken during the course of a lawsuit'.
