Lawyers are less protected when information is held digitally than on paper, a new study on European jurisdictions has revealed.

Legal professional privilege laws need to catch up with the digital age, according to Europe’s main legal professional body.
The Council of Bars and Law Societies of Europe (CCBE)  has conducted a comparative study looking at how the privileged professional data of lawyers is susceptible to government access.  It found that the rules on the interception of data transmission was often much weaker than rules of search and seizure of evidence.  It also found that  data held ‘in the cloud’ on behalf of lawyers, often had less protection in some European jurisdictions than if it were held in the lawyer’s office.
