New York Sugary drinks ban struck down

A New York court has refused to ban 'supersized' sugary drinks in the face of mass protest from the industry.

The ban, which was due to take place today, would have stopped  food outlets and restaurants selling sugary drinks in portions bigger than 16 ounces.It was due to be implemented to fight the obesity epidemic and had received much praise from health authorities.However, the New York state judge found that the city was ‘permanently restrained from implementing or enforcing’ the regulation as the board of health had overstepped its authority by proposing it.

The ban, which was proposed by Mayor Michael Bloomberg, was also said, by the judge, to be ‘arbitrary and capricious because it applies to some but not all food establishments in the city.’ He added that it also excluded other beverages with higher concentrations of sugar.
