Non-EU employers warned over EU litigation risk

EU rules which came into place on Saturday, January 10, mean that multinational employers with no EU presence could be subject to EU rules through employees working in the area.

London-based law firm CM Murray is warning clients of the changes which sees the Brussels Regulation (EU) 1215/2012 replace that of (EU) 44/2001, making important changes on jurisdictional issues. The firm says: 'Whilst the jurisdictional aspects pertaining to employment are similar to the existing Regulation, the recast Regulation contains important changes for non-EU employers, including the extension of the right of employees to sue non-EU employers in the court of a Member State.  This right will apply even if the employer has no place of business, branch or agency in the EU.'
