Paul Hastings lawyer warns of aggressive US law departments

Korean companies considering entering US markets need to be aware of the aggressive stance of many US businesses, according to Jeff Randall, global IP litigation head at Paul Hastings.

Paul Hastings represents Kolon Industries which got a hostile reception in just such a case. Mr Randall said: ‘Aggressive involvement of the US government reflects the rising number of American in-house legal departments viewing intellectual property matters as a means to generate profits for the company. They are actively seeking enforcement lawsuits against foreign companies.’

Government involvement

A case between Kolon and US major DuPont is going through the  US courts with US919.9m of damages being awarded to DuPont and then being overturned. Mr Randall expects the case to be finally decided by the end of 2014. He added: ‘The US administration has established various initiatives, programs, enforcements, policies and priorities every year towards protecting the US intellectual property (IP) rights and making it easier and more effective, increasing penalties against foreign companies.’ Source: Korea Times
