The Svea Court of Appeal has ruled against Mars in a trademark dispute with Kraft Foods and ordered the chocolate maker to stop selling M&Ms in Sweden, at least not with the customary lower-case letters it uses on its packaging and colourful chocolates.
Exclusive rights
The court said that Kraft, which sells chocolate-covered peanuts under the Marabou brand with a single "m" on the packaging, has exclusive rights to the trademark in Sweden. But it added that using the upper-case M&Ms, as Mars does in its corporate communications, does not constitute a trademark infringement in the country.
