During an appearance on NBC's ‘The Tonight Show’ in January, Mr Maher joked that an orangutan's fur was the only thing in nature that matches the shade of Mr Trump's hair, reports Yahoo News.
Birth certificate
He then offered a $5 million donation to the charity of Mr Trump's choice – suggesting ‘Hair Club for Men’ as a prime candidate – if Mr Trump could a birth certificate that proved he was not half-ape, in a thinly disguised attack on Mr Trump’s own comments on President Barack Obama’s records.
According to the report, records in Los Angeles Superior Court show Mr Trump requested the lawsuit be dismissed without prejudice last week. His spokesman, Michael Cohen, claimed that an amended lawsuit would be filed sometime in the future.
'Venom'
Legal experts have said that a lawsuit would be unlikely to succeed due to the joke nature of the claim, however Mr Trump has responded by claiming that the attack ‘was venom’, adding that it ‘wasn’t a joke’.
Mr Maher is yet to comment on the events.
